Terms and Conditions

  1. DEFINITIONS.

The terms “Pisadas”, “us”, “ours” refer to Dorado Travel SRL., Authorized Travel Agency EVT 13686. The term “client” and “you” refer to the User of our website, also to the person that should contact us through telephone, email, personally at our local agency or by any other means. The term “reservation” refers to the interest perpetuated by the client and the contact generated without binding agreement on our side. The term “offer” refers to the commitment that both parties assume within each other, in relation to the package in question. The term “package” refers to the combination of two or more touristic products/services booked and/or offered through Pisadas, that can be part of the same trip or combined with more travel options. As a condition of your use of this website and our services, you warrant that you possess the legal authority to create a binding legal obligation according to the laws of your residence. If you do not possess this legal capacity, those responsible for you assume the responsibility on your behalf. You can also make legitimate reservations for you or for another person for whom you have authorization by notary to act on their behalf; for example in the case of a legal representation for a company, you must possess accurate representation.

  1. If the user does not possess legal capacity or exceeds them, he/she will be held personally liable. Bear in mind that at the moment of placing a reservation through Pisadas, the client guarantees: a) compromise on the interest of obtaining the package, b) that he/she is legally capable to sign contracts and agreements, c) will limit the use of Pisadas’services to book packages for him/herself or on behalf of a third party for which he/she has full representation, and d) that all information supplied by him/her is true, accurate, current and complete
  2. Pisadas is an online platform and local agency between you and the suppliers and vendors of services you book. These terms and conditions are general and will apply to the services that we provide but do not replace or modify the terms and conditions specified by each supplier or vendor.
  3. It is your responsibility to review and verify all the documentation and information relevant to your reservations with the email you have provided us. In order to complete and secure your reservation, you need to use your correct email address. We understand that you are aware of the confirmation of your reservation or of any other notice relevant to your booking through the email you have provided us.
  4. The personal data that you provide to us will be used for operating the booked services as well as for marketing and commercial activities.Pisadas may disclose this information to suppliers and service providers in order to operate the booked services.Pisadas does not sell or disclose personal data to third parties not involved in the operation of the services.
  5. You must complete all the fields with accurate data and personal information in order to make a reservation and/or book any of our services. When submitting your information on our website,via email or by any other means you confirm that your data is complete and correct to the best of your knowledge. You will be responsible for updating your information when necessary. Pisadas holds no responsibility for the accuracy of the information you have provided.
  6. After booking your travel package you are responsible for ensuring that you meet foreign entry requirements to all the countries visited in the tour/package, that your travel documents(such as passports and visas) are in order and that any other foreign entry requirements are met.

We urge customers to review travel prohibitions, warnings, announcements and advisories issued by the relevant governments prior to booking travel to international destinations.

Passport and Visa: You must consult the relevant Embassy or Consulate for this information. Requirements may change and you should check for up-to-date information before booking and departure. We accept no liability if you are refused entry onto a flight or into any country due to your failure to carry the correct and adequate passport, visa or other travel documents required by any airline, authority or country, including countries you may just be transiting through. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.

  1. We, Pisadas, act as an intermediary between you and the Supplier, transmitting the details of your reservation to the relevant Supplier(s) and sending you a confirmation email for and on behalf of the Supplier. Herein we do not guarantee the final destination chosen does not present risks to the health and/or integrity of the traveler.

We are not liable for any damages or loss of any of your belongings as well as of those of others traveling within your group. We are not liable for any force majeure events such as climate catastrophes, union strikes or any other event that could occur during the length of your trip and that could in any case delay, postpone or cancel part or the whole of the booked services.

Health: You should consult your doctor for current health recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication and follow all medical advice in relation to your trip.

  1. When you book through Pisadas, you do so directly with the service providers chosen by you. The ticket or voucher issued as a result of this transaction confirms the operation and embodies the acceptance by you of the terms and conditions of the final party.

Pisadas, as an intermediary, is not obliged, directly or indirectly, to the execution of the services.

On the other hand, all reservations and/or bookings are issued on the name of the user and are therefore not subject to transfer.

  1. Before confirming your reservation or offer, we advise you to please review the cancellation and change policies. This is to ensure that you understand the terms, conditions and penalties applicable. Pisadas is not responsible and has no implication in the penalties that may be charged to you by the Suppliers.
  2. The suppliers are exclusively responsible for updating their information. When rendering our services, the information that we disclose is based on the information provided to us by Suppliers. As such, the Suppliers are fully responsible for updating all rates, availability and other information displayed on our platform or sent to you via email or any other means. Although we will use reasonable skill and care in performing our services, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions on our platform, any inaccurate, misleading or untrue information or any non-delivery of information. Each Supplier remains responsible at all times for the accuracy, completeness and correctness of the informationdisplayed on our Platform or provided to you via email or any other means. Our Platform and any information we give to the client does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or rating of any Supplier,nor its facilities, venue, products or services made available.

Pisadas recommends you to browse and read the comments provided by other passengers regarding the packages you are interested on booking. Reading their terms and conditions is also prudent. We also suggest you print them next to your electronic ticket and voucher or travel confirmation.

  1. Pisadas’ website contains hyperlinks to websites operated by parties and suppliers other than Pisadas, with their own privacy and confidentiality policies. Such hyperlinks are provided to your reference only. We do not control such websites and are not responsible for their contents or privacy or other practices of such websites. Further, it is up to you to take precautions to ensure that whatever links you select or software you download from Pisadas’ website or other websites is free of such items as viruses, worms, trojan horses, defects and other items of destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators. Therefore, we recommend you to carefully read and analyze the confidentiality practices and policies of such websites whenever you visit them.

 

  1. Who are we?

Pisadas (Dorado Travel SRL) is a travel agency duly enrolled at the National Tourism Ministry under the File EVT 13686. The National Travel Agents Act (Law # 18.829, and its regulatory decree and other resolutions sanctioned by the National Tourism Ministry) regulates our business activity.

Pisadas acts as an intermediary between you and the service providers chosen by you. We provide you with the information relevant to the characteristics of each service, coordinate your reservation request,collect and process payments, and provide support and search for solutions whenever a situation may arise.

It is important to remark that Pisadas is not the final provider, but solely an intermediary. The information posted on our website, sent via email or provided by any other means, related to prices, servicecharacteristics, availability, sales conditions, restrictions, cancellation policies or reimbursement, amongst others, is provided by the final vendors and suppliers, and in the case of airfare, they are previously approved by the Air Authority. We suggest that you validate the conditions prior to booking. Any complaint or demand regarding the chosen service or travel package must be directed to the final suppliers. Remember the suppliers are the ones obliged to provide and execute the services.

 

  1. When do I have a reservation and what is a proposal?

Pisadas defines “reservation” as the act where you express the intention to formalize the contact with us, towards preparing your travel package. This does not imply a payment or expense of any sort from the client side, nor that does it mean a compromise from Pisadas.

Pisadas will validate availability and price alternatives and information regarding the final destination.

To advance in the process the client must make a proposal, that means agreeing on the services quoted by Pisadas and proceeding with the total payment for the services. By making a proposal the client states that he/she has read and accepts this Terms and Conditions.

The payment not completed in due time will not have effect and the reservation will be lost. Review the payment terms by each bank; some have clearing times that take longer than others.

 

  1. PRICE

When you purchase a travel package through Pisadas, you must pay the price or fare of each service included in this package, including taxes applicable plus the charge of our intermediary fee if applicable. Pisadas will provide you with the correspondent ticket and will transfer your payments to the final supplier. Bear in mind that the supplier, without any intervention from our side, determines fares correspondent to each service. Pisadas cannot guarantee the prices. Should they vary they depend solely on the Supplier.

 

  1. PAYMENT FORMS

All payments due for the services purchased should be complete in United States Dollars (USD) at the final date of purchase.

When the purchase is online through our intermediary, you accept that Pisadas will charge your credit card the total payment, which includes taxes and other travel fees plus the service charge on our side. Remember we do not set the prices and/or fees. Pisadas will provide you with payment alternatives applicable to the Travel Package of your choice. Once you confirm your reservation, the final price is fixed and the prices and fares are determined. Please review all your documents before executing your final decision.

We inform you the payment options available with the travel packages prior to your reservation.

Your credit card information provided by you will be used to complete the payment. When you upload this information, you are authorizing us to charge the full price of the travel package, taxes and our service fee, in all cases.

When you pay for a reservation with credit card installments or any form of segmented payments, take into account that:

  1. The service fee for our service ischarged on the first payment.
  2. Interests and taxes generated by the payment method are added to the final price.
  3. If your bank charges a life insurance that adds a financial cost, remember to check with the bank how this affects your bank charges. We recommend reading the terms and conditions from your financial providers. Pisadas will not reimburse any interests from the original transaction.
  4. When the operation is done with international providers, some banks and financial operators charge extras according to their local regulations. Additionally, your financial provider may have to convert prices to local currency and a rate difference may occur. The bank fixes the rate for international transactions. In case of doubt, contact your bank prior to payment. Pisadas will not reimburse any of these costs.
  5. Prices for each service included in the Travel Package of your choice are charged separately. Before accepting the transaction, verify you have sufficient funds to complete the payment. Once the full price is payed will you have your reservation confirmed.

When you pay via bank transfer, remember the process usually takes up to 5 working days and may have delays of over 10 working days. In addition, each bank may have a specific time schedule, according to its location. Pisadas takes no responsibility for the financial institutions’ transfer times, processes, delays or inconveniences. It is exclusive responsibility of the client to get informed and consider the money transfer time when making the payment for the travel package.

Pisadas will only confirm your proposal once the payment is received in due time. Should this not happen, your proposal will be invalid.

 

  1. Proposal Process/Bidding process

When you make your proposal, whether in person, via email, through our website or by any other means, you authorize us to represent you before our vendors and suppliers regarding the travel services offered by them through Pisadas. This also includes the capacity to book and charge the services to your credit card or chosen payment method on your name.

Please be attentive to all our communications. They may include relevant information regarding the status of your travel itinerary.

Until complete payment, the suppliers or vendors can cancel the proposal. Once the electronic tickets, vouchers or confirmation are issued your reservation is confirmed.

If your proposal request is not confirmed and you have paid a percentage of the travel package price, this will be part of the booking guarantee. If the proposal is rejected for any given reason, Pisadas will inform you the possible alternatives in the case that you would like to insist on your proposal.

Suppliers and vendors can change and/or modify prices, schedules and reprogram services for different reasons not subject to Pisadas’ control. If any of these or all of these situations occur, Pisadas will inform you of the possible alternatives and will apply your partial payments to the new travel package after your acceptance of the new option.

 

  1. Can I cancel after the term? Is my ticket or travel package refundable?

Each supplier and vendor has their own terms and conditions that apply when a cancellation is requested after the time established. We recommend you read assertively and attentively all the conditions prior to payment. Special conditions may apply and in some cases refunds are not applicable. Penalties may apply.

Pisadas will offer the best representation and follow up on your request, but the final decision is left to each supplier. If the supplier authorizes the refund, and the reservation was payed through Pisadas, the funds will be directed through the same payment method. For example if you pay with credit card we will refund you to the same card the total or the partial payment according to the amount refunded by the supplier.

The fee charged by us, Pisadas, is non-refundable. In the total refund this fee will not be included. If you request a change on your package, Pisadas may charge an extra fee for this new service.

 

  1. Once I’ve made my offer, may I change it?

Each final provider or supplier establishes the conditions and penalties for changes. When you accept the reservation and make your proposal, you agree to these terms.  Each travel package contains the penalties for changes.

Remember that Pisadas has no part in these conditions.

When making changes a difference in fare may apply. Please inform yourself before requesting the change. In the case that you request a cancellation or change, Pisadas may charge a fee for this extra service.

 

  1. Applicable law to travel packages

We inform you that the scope of our services and our travel business is subject to the laws of the Argentine Republic. These include and are not limited to our National Commercial and Civil Code, Consumer Act (24.240), National Travel Agents Act (18.829), Regulatory Decree 2182/72, amongst others. The laws applicable to Air Transit regulate airlines liability. If you have a conflict regarding your air transport, you can do so before the National Civil Aviation Administration (http://www.anac.gov.ar). This institution regulates, governs and certifies the aeronautic commercial activity in Argentina. Take into consideration that during your trip or prior to your departure delay may take place due to climate conditions, obstruction of airport runways, etc. at both the departure airports and arrival airports. If there is a force majeure situation, unpredictable or unstoppable, these liberate the liability from the airline company but oblige them to compensate or provide alternative solutions, including accommodation. In any other cases where the operation affects solely the airline company, the responsibility and or liability regulated by Aeronautic Regulation establishes penalties.

 

  1. DOCUMENTATION

The terms and conditions contained in this document will be contemplated as part and will be applied to all the operations and transactions celebrated and or executed between you and Pisadas. Additionally to these terms and conditions, each service, product or package may have specific terms and conditions, which you are subject to as well.

These documents may complement, modify or eliminate part of the terms here exposed. Your acceptance of these Terms and Conditions particular to your purchase are mandatory when you purchase or acquire one of these services or products.

All the terms contained in this document together with the specific terms agreed with Pisadas within a particular travel package, the details of the services to be provided, the electronic transport tickets, the purchase orders, the invoices and any other document that contains specifications to your travel arrangements will be part of the travel contract agreement.

 

  1. APPLICABLE LAW AND JURISDICTION

The binding Argentine Republic Laws govern this Agreement. Any conflict that may derive from this agreement, its existence, validity, scope, interpretation, and compliance, is to be submitted to the local ordinary courts of the Autonomous City of Buenos Aires.

 

These terms and conditions have been last updated on October 30th2018. In the case of future changes or updates, the new terms and conditions will be published on Pisadas website (www.pisadas-argentina.com).
